Pashukanis (1891 - 1937) and his theory have gained a topical place both in the history of the philosophy of law and in the political philosophy of law, as well as in the economic theory of law, the critical theory of law, etc., But how should we appreciate the contributions of Marxism and the theory of Pashukanis to the philosophy of law, and moreover how should we critically understand Pashukanis' emblematic book: The General Theory of Law and Marxism (1924), which continues to sparkle debates and controversies, as well as draw admiration and praise.
These are the questions that Professor Bjarne Melkevik of the Law School of Laval University (Quebec - Canada), asks in his study. His analysis places Pasukanis' theories inside their geographical and historical context: the former URSS's political philosophical context and its controversies about communism, revolutionary endeavour, Marxist theory, ideological rectitude, and the harsh political reality of oppression, persecution and fanaticism.
The author examines the ideological sources and works used by Pasukanis to criticize and explain his reading of Marx's works. It all about Marx of course, but also about Engels, Kautsky, Lenin and Stalin. During this tormented period that dealt with the conflict between the proletariat and the bourgeoisie, between capitalism and communism, between democratic ideals and state-power, how could juridical modernity persevere and how could this serve a sound understanding of the philosophy of law? And, more specifically, did the socialist ideology of this ex-URSS thinker Pashukanis really make a significant contribution to the philosophy of law and critical legal thinking?
