(??????, ??????). __________If, in the legal world, epistemology tends towards the unrewarding role of an a priori, ready to transmute itself ideologically into legal methodology, into a theory of interpretation, or simply into a pre-established "theoretical model, " we have a huge and real problem. The aim of our book is consequently to rethink this issue and to do so under the auspices of an interrogation which is itself a theorisation of the meaning of legal epistemology. It is imperative to criticize and evict, as far as possible, the ideological recourse to an "already-law" - a juridical meaning already there in one way or another - and which can act (without any deliberative act of creation) as a justification, foundation and ideology in the field of law, or worse as an " ideo-law " exclusive to its investigator-members of a doctrinal sect.
The three essays that we publish here under the title "Legal Epistemology and Already-Law" seek to reclaim the field. They present a critique of any foundation (and fondationalism), of any justification (and process of justification) and any attempt to turn theory into a paradigm for "law" and legal science. They are critical essays of resistance to these "sirens songs" which, like in Ulysses Epic (in Homer's Odyssey), may well be bewitching and beautiful, but will cause our intellectual and moral shipwreck if we do not stand up to them.
We must never yield to the temptation of believing in the existence of an "already-law", a law already here and there, and magically present in an objective world ready to be plucked by our theory. There is no reason to yield to the irrational. Rather, we must resist, protest and howl epistemologically against the irrationality of an "already-law". Bjarne Melkevik, S. J. D.
