Résumé

A comprehensive assessment of the cross-border issues that will affect UK firms selling investment services and products after the UK has left the EU. We look at the situation where UK financial services firms are unable to make use of European passports, i. e. the UK as a third country in relation to the EU. The paper also looks at consequences for EEA and non-EEA firms wishing to market into the UK.
Using the methodology that BRP Bizzozero & Partners has developed for assessment of cross-border activity, the paper provides a broad view of barriers to cross-border activity and applies this to the specific and so far unprecedented case of a major country such as the UK leaving the EU.
Alessandro Bizzozero : Doctor in Law, holder of a license to practice law, former Director of the CAS in Compliance Management and lecturer at the University of Geneva. He benefits from more than 20 years of experience in the banking and regulatory field. He is also the author of several publications, including "Financial cross-border activities into and out of Switzerland". Richard McGrand : After graduating from the University of Bristol, Richard started his career as a securities regulator.
After six years as a regulator and having obtained the Securities Institute Exam Diploma, he then joined the private sector, working for several financial institutions. He has been Head of Compliance for two Swiss banks in the UK and has worked on cross-border issues since the 1990s. Boris Bartels : Holder of a license to practice law in Germany and of an MBA from the Mannheim Business School, Mr Bartels practiced law in a German law office and a tax consultancy firm, with a focus on investment and succession law.
