Mittelalterliche und frühneuzeitliche Testamente können als Fundgrube für geschichtliche, aber auch kultur-, rechts- und sprachgeschichtliche bzw. sprachwissenschaftliche Untersuchungen angesehen werden. Die Vielfalt der in diesem Band dargebotenen Perspektiven zeigt Testamente als eine in vielen Aspekten alltagsnahe Textsorte, und das obwohl sie Verschriftlichungen von Rechtsgeschäften waren. Die Beiträger:innen stammen aus vielen europäischen Ländern und beziehen sich in ihren Untersuchungen vor allem auf lokale Quellen.
Sie zeigen, dass nicht nur ein diachroner, sondern auch ein diatopischer Zugriff auf die Forschungsergebnisse einen Einfluss hat. Sehr interessant sind dabei die Fragen der Implementierung der westlichen Rechtsordnung auf Ostmitteleuropa, wo es zur Überlappung verschiedener (Rechts- und Kultur-)Traditionen gekommen ist - wobei diese Implementierung im südlichen Ostmitteleuropa äußert willkommen und sogar begehrt war. Medieval and early modern testaments can be regarded as a treasure trove for historical, cultural, legal, and linguistic research.
The various perspectives presented in this volume demonstrate testaments as a text genre that are in many respects close to everyday life, even though they were written records of legal transactions. The contributors in this volume come from various European countries and mostly focus on local sources. They show that both a diachronic and diatopic approach play a significant role in research findings.
Questions on the implementation of the Western legal system in East Central Europe are of particular interest as various (legal and cultural) traditions overlapped. However, this implementation was warmly welcomed and even requested in East Central and South-East Europe.
