The Expropriation Act 13 of 2024 empowers the Minister of Public Works to expropriate property in the public interest or for a public purpose and subject to compensation, the amount of which and the time and manner of payment of which have either been agreed to by those affected or decided or approved by a court. In certain instances the compensation payable can be nil. Who would have thought that the replacement and upgrading of legislation that had already been on the statute books of one country for decades (and which has counterparts in most other countries) could have caused an international furore!Well, the Expropriation Act 13 of 2024 to which President Ramaphosa added his assenting signature in January 2025 managed to do exactly that.
