Die funktionale Methode im dynamischen Sachenrecht Schwedens aus deutscher Perspektive

Das schwedische Sachenrecht verfolgt mit seiner Aufteilung in dynamisches und statisches Sachenrecht eine dem deutschen Recht unbekannte Strukturierung. Luise Pelzer analysiert in dieser Studie das schwedische Verständnis von Eigentum und hinterfragt die in Schweden vorgetragene Annahme der Irrelevanz des Eigentums in der Transaktionssituation. Sie untersucht die Auswirkungen der funktionalen Methode auf das schwedische Sachenrecht mit seinem Fokus auf Dreipersonenkonflikte und ihre Hintergründe im skandinavischen Rechtsrealismus.
Dabei wird deutlich, dass sich Anspruch und Wirklichkeit nicht immer decken und die Abkehr von Rechtskonzepten weniger Mehrwert als eine schwer überschaubare Vielfalt an Einzelfällen mit sich bringt. Gleichzeitig gelangt der schwedische funktionale Ansatz zu vertretbaren praktischen Ergebnissen und zeigt so anschaulich die Vielfalt sachenrechtlicher Vorstellungen in Europa auf. Luise Pelzer analyzes in this study the Swedish understanding of ownership and questions the assumption of the irrelevance of ownership in the situation of transfer of title, which is presented in Sweden.
She examines the effects of the functional approach on Swedish property law with its focus on three-person conflicts and its background in Scandinavian legal realism. It becomes clear that claim and reality do not coincide and that turning away from legal concepts brings less added value than a hardly manageable variety of individual cases. At the same time, the Swedish functional approach achieves acceptable practical results and thus clearly demonstrates the diversity of legal concepts of property law in Europe.
